Terms and Conditions for eSurplusAuction Purchases
PAYMENT: All payments shall be made by Cash, Money Order or Cashier Check. Payment is due within Ten (10) days after the close of auction. You must arrange for payment and pickup within 48 hours of the close of the auction. Failure to purchase items awarded may result in a permanent ban from future auctions and result in closure of your account.
REPRESENTATION AND DESCRIPTION: We have tried to describe each item to the best of our ability. Be aware that we do not always have first hand knowledge of the items sold. All descriptions of items in this sale are believed to be correct, but no warranty, as such is either expressed or implied.
HOLD HARMLESS: Bidders hereby agree to hold harmless Montgomery County Public Schools and its employees for any or all omissions or errors. Purchasers must understand that he/she is buying the property entirely upon his/her own examination, evaluation, or opinion based on the information given in each items posting.
WARRANTY: Each item or "lot" of items are sold "AS-IS" and with all faults and defects therein. The items purchased immediately become the responsibility of the purchaser at the time it is sold by Montgomery County Public Schools. All technology equipment such as computers, monitors, printers, copy machines, and other related items sold with the possibility of missing parts or components unless specified in each items auction. Any costs to make an item functional are the responsibility of the awarded bidder. Other items which require repair, maintenance, or additional investment is also the responsibility of the awarded bidder.
LEGAL: Technology equipment, such as computers is not sold with the intention to transfer ownership of any software or operating system. Hard drives are formatted unless determined to be defective. Montgomery County Public Schools are not licensed to sell software and cannot provide software to a buyer. If residual software exists, it is by oversight.
WITHDRAWAL OF ITEMS: Despite our efforts to avoid withdrawal of items from the sale after they have been advertised or offered, it may become NECESSARY; therefore, Montgomery County Public Schools reserves the right to remove any, all, or any portion of items from sale or auction prior to an initial bid.
REMOVAL: We are not equipped for shipping; items are available for local pick up only. All items must be removed within ten (10) days following the close of auction for the awarded item(s). All loading and labor costs are the responsibility of the buyer. Any item left after the removal deadline will be subject to resale (to the next lowest bidder) without any obligation to refund any amount to the original buyer.
