All bidders in this auction agree that they have read and fully understand these terms and agree to be bound by them.


Basis of Award:
Award will be based on the highest bid per item. Glynn County, Georgia (also referred to as Glynn County or the County) reserves the right to waive technicalities and irregularities, accept the bid deemed most advantageous, or reject any or all bids. All interpretations of bid proposals by Glynn County are final. The individual determined by Glynn County to have the highest acceptable bid shall be considered the Winning Bidder (also referred to as the Buyer).

Eligibility:
Bidders must be at least 18 years of age and legally able to enter into binding contracts. Glynn County employees and members of their households are prohibited from bidding on items.

Inspection:
The responsibility to determine the condition of the property rests solely with the bidder. Glynn County strongly recommends that prospective bidders conduct on-site inspections to determine the condition, suitability, and safety of items prior to bidding.

Pictures represent the actual items, and descriptions are provided to the best of our knowledge based on visual inspections and available information. Defects not listed, shown, or known may exist. Failure to inspect property prior to bidding does not relieve the bidder of responsibility to complete the purchase.

Warranty:
All items are sold as is, where is, and with all faults. No refunds will be issued.

Glynn County disclaims all warranties, express or implied, including but not limited to warranties of condition, quality, completeness, fitness for a particular purpose, or compliance with safety regulations. Item descriptions are believed to be accurate; however, neither written descriptions nor oral statements shall be considered warranties.

Indemnification:
No claim shall be considered for adjustment or rescission of sale based on failure of the item to meet the Buyers expectations. Glynn County does not guarantee that items meet safety standards.
The Buyer, including heirs and successors, agrees to defend, indemnify, and hold harmless Glynn County, its employees, and agents from any and all claims arising from or related to the property, including but not limited to bodily injury, death, property damage, or contractual liability.

Personal and Property Risk:
Persons attending inspection, sale, or removal of items assume all risks of damage or loss to person or property and release Glynn County from any liability.

Payment:
Awarded items must be paid in full within five (5) business days of the auction closing. Acceptable forms of payment include U.S. currency (in person only), certified cashiers check, or money order.
No property may be removed prior to full payment. If an item is not claimed by the Winning Bidder, the County reserves the right to re-auction or offer the item to the next highest bidder. All bids constitute a binding contract. Defaulting bidders may be restricted from future auctions.

Item Pick-Up:
All items must be picked up by the Winning Bidder at:

Pick-up is by appointment only. Contact the Public Works front desk at (912) 554-7746 or bmayer@glynncounty-ga.gov to schedule. Pick-up hours are Monday through Thursday, 8:00 a.m. to 3:00 p.m., excluding holidays.

The Buyer is responsible for all loading, removal, and transportation at their own expense. Items must be removed within ten (10) business days of the auction. Failure to do so may result in the item being relisted or disposed of, and payment may be forfeited as abandoned property.
Buyers must allow sufficient time for loading prior to closing hours. A valid photo ID is required for payment and pickup. If a third party is authorized to pick up items, they must present a signed authorization letter along with a copy of the Winning Bidders photo ID.

Under no circumstances will Glynn County provide packing, loading, or shipping services. It is strongly recommended that all vehicles be towed from the premises.

Vehicle Titles:
A bill of sale and title will be issued upon receipt of payment. Titles will be issued in the name of the Winning Bidder only. Open titles are not permitted, and replacement titles will not be issued. Titles may be subject to restrictions noted in the item description.

State/Local Sales and Use Tax:
Glynn County may collect applicable sales tax and buyers premium fees unless a valid tax-exempt certificate is provided prior to payment. If applicable, taxes will be displayed during the bidding process and included in payment.
