About Motors For Good
Motors For Good is a 501(c)(3) public nonprofit organization that acquires and sells donated vehicles in order to support programs serving families and children in need. For more information about Motors For Good and our mission, please visit www.motors4good.com.
Vehicles come to us from a number of different sources, and in most cases we do not have prior history with the vehicles we sell. We make reasonable efforts to represent the general condition of vehicles, but we are not mechanics and vehicles do not undergo mechanical inspections prior to sale.
Prospective buyers are welcome to inspect vehicles prior to bidding. Vehicles may not be removed from the premises for inspection or test drives.

Contract
An award of sale constitutes a binding contract between the winning bidder ("Buyer") and Motors For Good upon the terms and conditions set forth herein. Motors For Good may pursue all legal remedies allowed by law against any bidder who fails to make payment for a winning bid or otherwise defaults under these Terms and Conditions.
Conflict of Terms
In the event of any conflict or inconsistency between these Terms and Conditions and any information provided in a PublicSurplus.com listing, advertisement, description, photograph, or communication, these Terms and Conditions shall control.
Inspection Responsibility
YOU ARE RESPONSIBLE FOR INSPECTING ANY VEHICLE YOU BID ON. Bidding without inspecting the vehicle is strongly discouraged.
All sales are final. There are no refunds or returns.
Guarantee Waiver (AS-IS / WHERE-IS)
All property is offered for sale "AS-IS, WHERE-IS." Motors For Good makes no warranty, guaranty, or representation of any kind, expressed or implied, as to the condition, usability, value, merchantability, authenticity, or fitness for any purpose of the property offered for sale.
Vehicles do not undergo mechanical inspection and may contain unknown defects.
Because Motors For Good cannot guarantee that safety systems such as brakes, airbags, seat belts, steering components, or windshields are in proper working order, all vehicles are sold as tow-away vehicles. Buyers who choose to drive vehicles away from the premises do so entirely at their own risk.
Buyer acknowledges that they may not rely upon any information provided by Motors For Good or its agents, whether orally, in writing, or through digital images. This includes, but is not limited to:
* year
* make
* model
* condition
* damage type or damage amount
* drivability
* accessories
* mileage
* odometer disclosures
* vehicle identification number (VIN)
* title history
* repair history
* prior accidents or total loss history
Buyer is solely responsible for confirming, researching, and inspecting all information regarding the type, condition, status, and history of vehicles before bidding.
Motors For Good and its agents shall not be responsible for any representations or statements concerning any vehicle, its prior use, condition, suitability for a particular purpose, or its suitability for which it is customarily devoted.
No Description Warranty
Motors For Good is not responsible for omissions or errors in the description of items being offered for sale. It is the bidder's responsibility to inspect and satisfy themselves as to the condition and details of the item prior to bidding.
Indemnification
The bidder agrees to indemnify and hold Motors For Good harmless from any claim, demand, or cause of action arising from the sale or use of any property purchased through the auction.
Consideration of Bid
Motors For Good reserves the right to reject any and all bids and to withdraw any item from sale prior to issuing a Notice of Award.
Reserve Requirement
If a reserve price exists and is not met, Motors For Good reserves the right to relist the item, sell to the next highest bidder, or otherwise dispose of the item at its discretion.
Notice of Award
Successful bidders will receive a Notice of Award by email from PublicSurplus.com.
Payment
Payment for an awarded item must be received within five (5) business days after the date of the Notice of Award.
Payment methods accepted:
* Credit Card / Stripe (3% processing fee applies)
* ACH Transfer
* Wire Transfer
No cash, checks, or money orders will be accepted.
Partial Payment
Partial payments are not allowed. Payment must be made in full using a single payment method.
Wire Transfers
For purchases exceeding $4,000, payment by wire transfer is required.
Buyer Premium
A buyer premium of 10% will be added to the final sale price.
Sales Tax
Sales tax will be applied according to the buyer's residency as follows:
* Out-of-state buyers: No sales tax collected
* Colorado residents: 2.9% Colorado state sales tax
* La Plata County, Colorado residents: 5.9% total sales tax (2.9% state + 3% county)
Applicable taxes will be billed and collected separately from the Public Surplus invoice by Motors For Good.
Buyers are responsible for ensuring that correct residency information is provided.
Pick-Up Procedures
After payment is received, the Buyer must contact Motors For Good to schedule pickup.
Buyers must present:
1. Notice of Award
2. Paid Receipt
3. Government-issued photo identification
Authorized third-party pickups must provide written authorization from the winning bidder and valid identification.
Shipping
Motors For Good does not provide shipping services. Buyers are responsible for arranging pickup or transportation.
Removal
Buyer must remove auction items from Motors For Good premises within ten (10) business days after the Notice of Award.
The Buyer is responsible for packing, loading, and transporting all purchased property.
Motors For Good will not provide labor, equipment, or transportation assistance.
Vehicle Abandonment and Storage
If a Buyer fails to remove a vehicle within ten (10) business days after payment, the vehicle may be deemed abandoned.
Motors For Good may, at its sole discretion:
1. Retain all payments made
2. Charge storage fees of $35 per day
3. Store the vehicle for up to ninety (90) days
4. Resell or otherwise dispose of the vehicle without further notice
Any resale proceeds shall belong solely to Motors For Good. The Buyer shall have no further claim to the vehicle or any funds paid.
Vehicle Titles
Titles will be issued at the time of vehicle pickup with confirmed payment.
Open titles will not be issued. Motors For Good will not issue replacement titles.
Title will not be released until the vehicle is physically removed from Motors For Good premises.
Ownership Transfer
Ownership of the vehicle does not transfer until the vehicle has been physically removed from Motors For Good premises and title documentation has been delivered.
Risk of Loss
If property is lost or destroyed after the Notice of Award but prior to pickup, Motors For Good will refund the purchase price paid, provided the loss was not caused by the Buyer.
Motors For Good's liability shall not exceed the actual purchase price.
Default
Default includes:
* failure to comply with these Terms
* failure to make timely payment
* failure to remove property within the required time
Motors For Good may terminate the contract, retain payments or deposits, resell the property, and pursue any legal remedies available.
Governing Law and Venue
These Terms and Conditions shall be governed by the laws of the State of Colorado.
Any disputes arising from these terms or the sale of property shall be resolved exclusively in the courts located in La Plata County, Colorado.
Attorney Fees
In any legal action arising from these Terms or the sale of property, the prevailing party shall be entitled to recover reasonable attorney fees and court costs.
Acceptance of Terms
By submitting a bid, the bidder confirms that they have read, understood, and agreed to these Terms and Conditions and agree to pay for and remove the property within the deadlines stated.
These Terms and Conditions are subject to change without notice.
