Online Sales Terms and Conditions


1. Pre-Purchase Information

1. All properties are sold "as-is, where-is", with no guarantees or warranties of any kind. Some auction

listings may include multiple parcels.

2. To ensure equal access to information for all prospective bidders, all questions must be submitted

through the designated question section for the specific property on the Public Surplus website: https://www.publicsurplus.com/.

Questions will not be answered via telephone or email.

3. Properties that do not comply with applicable zoning regulations may not qualify for building permits.

4. No representations or warranties are made regarding property conditions, including but not limited to:

o Availability of water, utilities, sewer, or irrigation

o Legal or physical access, ingress/egress, or road maintenance

o Zoning compliance or subdivision status

o Suitability for development or construction

o Floodplain designation or other environmental factors

o Any other physical or legal characteristic

Bidders are solely responsible for conducting their own due diligence.

5. Title insurance may not be available for certain properties. Bidders are strongly encouraged to consult with a title company or legal advisor prior to bidding.

6. All sales are final. No refunds will be issued.

7. County staff are not authorized to provide advice or answer parcel-specific inquiries.


2. Notice of Award

Successful bidders will receive a Notice of Award via email from PublicSurplus.com.


3. Payment Terms

1. Payment must be received in full within five (5) business days following issuance of the Notice of Award.

2. If payment is not received within the required timeframe, the Board of Supervisors reserves the right to:

o Cancel the sale, and

o Award the property to the next highest bidder or re-list the property for auction.

3. Payments are processed by PayMac, a third-party payment processor on behalf of the Cochise County Board of Supervisors.

4. Accepted payment methods:

o Credit Card (online only)

o Wire Transfer

Cash, checks, and money orders are not accepted.

5. Partial payments are not permitted. All purchases must be paid in full using a single payment method.


4. Credit Card Payments


* Maximum transaction limit: $4,000.00 per transaction

* To complete payment:

1. Log in to your Public Surplus account

2. Select "My Stuff" → "Past Bids"

3. Select the applicable auction

4. Click "Pay Online" and follow the instructions

* A receipt will be issued via email upon successful payment processing.


5. Wire Transfers

* Required for payments exceeding $4,000.00

* To obtain wire instructions:

o Email: buyersupport@publicsurplus.com

o Or request via Public Surplus live chat

o There will be a link on your winning notice to the wire instructions

Instructions will be provided electronically and must be followed precisely to ensure timely

processing.


6. Deed Issuance

1. Within sixty (60) days after receipt of full payment, the Board of Supervisors will execute, record, and deliver a deed conveying the State's interest in the property.

2. The deed will be issued free of delinquent property tax liens (existing easements will remain).

3. Upon recording of the deed:

o All prior delinquent taxes will be extinguished

o The purchaser becomes responsible for current and future property taxes

4. Deeds will be issued in the name(s) provided on the Bidder/Deed Information Form.7. Fees

1. Administrative Fee: A non-refundable fee of $25.00 will be added to each successful auction.

2. Buyer's Premium: An 8% Buyer's Premium (minimum $1.00) will be added to the final sale price.

o This fee will be displayed during the bidding process.


8. Default

Default includes, but is not limited to:

* Failure to comply with these Terms and Conditions

* Failure to submit full payment within the required timeframe

* Failure to complete required obligations related to the sale

Consequences of default may include:

* Cancellation of the sale

* Forfeiture of bidding privileges

* Suspension from future auctions until the default is resolved


9. Acceptance of Terms

By submitting a bid, the bidder acknowledges and agrees that they:

* Have read and fully understand these Terms and Conditions

* Accept all terms without exception

* Agree to complete payment in accordance with the stated requirements if awarded the bid
