COUNTY SURPLUS PROPERTY GENERAL SALE TERMS & CONDITIONS
1.
CAVEAT EMPTOR: The descriptions provided are based solely upon
general observations. Items may need repair or be incomplete.
Potential bidders are invited and strongly advised to carefully
inspect property offered in the invitation prior to submitting a bid.
Failure to inspect property shall not constitute grounds for a claim
or for the withdrawal of a bid after the auction's close.
All
property listed in the invitation is offered for sale "AS-IS".
The County of Mohave, Arizona makes no warranty, expressed or
implied, as to kind, character or quality of any of the property, or
its fitness for any use or purpose.
Description
is for identification purposes only, and in no way guarantees
condition, completeness, or fitness for any use or purpose. This item
may need repairs, be incomplete, not function properly (or at all)
and/or require special licenses or permits to own or operate.
Any
oral statement or representation by any representative of the
Government, changing or supplementing the invitation or any condition
thereof, is unauthorized and shall confer no right upon the Bidder or
Purchaser. Further, no interpretation of any provision of the
contract, including applicable performance requirements, shall be
binding on the County unless furnished or agreed to, in writing, by
the Mohave County's Procurement Director or her designated
representative.
2.
ACCEPTANCE OF TERMS AND CONDITIONS: DO NOT BID unless you have read,
understood and agree to all the Terms and Conditions of this sale. By
submitting a bid, the bidder agrees that they have read, fully
understand and accept these Terms and Conditions of Online Sales, and
agree to pay for and remove the property, if the bid is accepted, by
the dates and times specified.
FAILURE
to abide by these Terms and Conditions could result in forfeiture of
sale property and/or being blocked from participating in future
County auctions.
3.
INSPECTIONS:
Surplus
Vehicle Auction Information: Viewing/inspections for Vehicles will
begin after the auction has been released. A list of current vehicles
can be obtained by contacting Fleet Services at (928) 757-0907 option
4. Bidders may inspect the vehicles at 3675 E. Andy Devine Avenue,
Kingman, Arizona 86401 Monday through Friday from 8:00 a.m. to 3:00
p.m.; no appointment is necessary. Public Surplus will be collecting
all payments for Mohave County on all successful surplus auctions. No
appointment is necessary to pick up vehicles. Hours for pick up are
Monday thru Friday from 8:00 a.m. to 3:00 p.m.
Miscellaneous
Surplus Auction Items: Inspections of other items are by appointment
only, Monday through Friday from 8:00 a.m. - 4:00 p.m. Please contact
the Property Custodian at (928) 753-0752 option 5 to request an
inspection appointment for NON-Vehicle related items. Appointments
must be made at least 12 hours prior to the close of the auction.
4.
BID DEPOSITS: Mohave County may require bid deposits in order to
ensure fairness and equity to all buyers as a way to decrease default
bidding. The deposit will be reversed if no default occurs or the
bidder does not win the auction. Public Surplus will collect and
retain the deposit if there is a default by the Bidder.
5.
BUYER PREMIUM: An 10%
Buyer Premium shall be added to the final sale price with a $1
minimum charge per auction to collect payment. The premium will be
visible during the bidding process and will be included in the
payment required.
State/Local
Sales and/or Use Tax. Mohave County will collect sales tax , unless
the Buyer has provided a valid tax-exempt certificate to Agency Name
prior to payment. If applicable, the sales tax will be visible during
the bidding process and will be included in the payment
specified.
6.
CONSIDERATION OF BID: Mohave County reserves the right to reject any
and all bids and to withdraw from sale any of the items listed.
7.
PAYMENTS: PayMac.
a third-party payment processing company, collects all payments for
Mohave County. Payments for an awarded item must be received within 5
business days of close of auction. Payments shall be made online by
Credit Card or by Wire Transfer. NO CASH, CHECKS, OR MONEY ORDERS
WILL BE ACCEPTED. The Credit Card limit per transaction is $4,000.00.
For payments larger than this amount, please follow the instructions
listed below:
Payment
by Credit Card: Login to the Public Surplus site. Click on the My
Stuff link and then click on the Past Bids link. Click on the
description of the auction and then click on the Pay Online link
located on the right hand side of the screen. Follow the steps to
complete the transaction. A receipt will be emailed to you once the
payment has cleared.
Partial
Payment: There will be NO partial payments allowed for an auction.
All auctions must be paid in full according to the specified payment
process. For example, you WILL NOT be able to pay partially for an
auction by Credit Card and pay the remainder by another payment
method, such as a wire transfer.
Wire
Transfers: For payments over $4,000.00, a Wire Transfer is required.
If you need to do a wire transfer, please email support at
buyersupport@publicsurplus.com asking for wire instructions or
request the instructions via live chat. These instructions will be
emailed to you. Please follow them exactly to allow for prompt
payment.
You
will need to bring the payment receipt and a valid photo I.D. when
claiming your auction item; otherwise the auction item(s) will not be
released to you.
ALL
SALES ARE FINAL
8.
REMOVAL: Property listed is offered on a competitive bid basis and
must be removed within TEN (10) business days from the close of the
auction. Do not bid unless you are able to remove the property within
the time allotted. If the Buyer, after making payment for an item,
fails to remove the item within the specified time, the County
reserves the right (1) to retain all payments; and (2) to dispose of
the item through another auction or otherwise.
Unless
otherwise provided, the Bidder shall be permitted to remove the
property only during normal business hours of the custodian agency,
Monday thru Friday from 8:00 a.m. to 3:00 p.m. for vehicles and road
equipment, and Monday thru Friday from 8:00 a.m. to 4:00 p.m. for
other items.
The
Property Custodian is not responsible for and will not make any
removal arrangements. The Bidder is solely responsible for making
arrangements, including labor for packing, crating, removal, and
transportation. Mohave County does not provide any shipping, crating,
loading or tools needed to move items. All industrial type equipment
used by Bidders on County property to load, unload, tow, repair,
modify, etc., must meet Occupational, Safety, and Health
Administration Standards.

Pick-Up
Procedures:
You
will be notified upon receipt of payment. You may then contact the
Property Custodian listed for the auction item and arrange for a
mutually convenient pick-up time. You must bring the following with
you to the pick-up location:

The
Notice of Award;
�
The
Paid Receipt;
�
Personal
identification (such as a Driver License).
You
must present all three identification items at the scheduled pick-up,
or the auction item(s) will not be released to you.
Vehicle
Titles: Mohave County will issue a title or certificate upon receipt
of payment. Titles may be subject to any restrictions as indicated in
the item description on the website. Open titles cannot be issued.
Mohave County will not issue replacement titles.
The
Property Custodian must be notified in writing of the removal
arrangements and have authorization from the Procurement Department
to release the property to anyone other than the Bidder. Should the
Bidder elect to have another person pick up the items, the following
items must be provided when claiming the auction item:
A
signed letter of authorization must be furnished;
A
copy
of the Notice of Award;
A
copy of the payment receipt;
A
valid photo ID.
9.
DEFAULT: If, after award, the Bidder breaches this Agreement by:
1)
Failure to furnish full payment within FIVE (5) business days after
close of auction, or
2)
Failure to remove the property within TEN (10) business days for all
items with the exception of heavy road equipment (60 days
removal),
The
Bidder shall lose all right to title and interest which he/she might
otherwise have acquired in and to such property as to which a default
has occurred. The Bidder agrees that in the event that he/she fails
to pay for the property or remove the same within the prescribed
period(s) of time, Mohave County will block the bidder from
participating in future auctions offered by Mohave County.
A
Default Bidder's privileges may be reinstated, at the Mohave County's
sole option, by paying a one hundred dollar ($100.00) reinstatement
fee. If the property was sold on a "per lot" basis and the
Bidder removes a portion of the lot but fails to remove the balance,
no portion of the purchase price will be refunded.
