Guarantee
of quality, etc., state responsibility for Surplus property
All sales of surplus property are "as is," and
the state takes no responsibility for and makes no guarantees with respect to
items sold: Provided that the state shall make a statement of the condition of
the merchandise, including major known defects, before sale. No sale shall be
invalid due to defects discovered after sale which may have been discovered by
a reasonable inspection of the property before sale.
All property is sold AS IS, WHERE IS.� Washington State University makes no
guarantee, warranty, or representation expressed or implied as to the quantity,
kind, size, quality, weight or description of any of the property or its
fitness for any use or purpose whatsoever.� All sales are final. Personal
inspection is strongly advised. Failure to
inspect the item shall not be grounds for any claim or property abandonment.
Consideration of Bid: Washington State University (�WSU�) Surplus
Stores reserves the right, as determined in WSU Surplus Stores� sole
discretion, to reject any and all bids and/or to withdraw from sale any of the
items listed.
NOTE: Not all items listed by WSU Surplus Stores are located on
the WSU Pullman Campus. Please note location of property and viewing hours in
each listing before bidding.
Contract: An award of sale is a contract between the winning
bidder and WSU and all sales are final.
No refunds or exchanges.
Payment: PayMac, a third-party payment processing company, receives all payments for WSU. Payment for an awarded item must be received within five (5) business days after the date of the Notice of Award of the winning bid.
Payment may only be made online by credit card, or by wire transfer. NO CASH, CHECKS, OR MONEY ORDERS WILL BE ACCEPTED. The credit card limit per transaction is $4,000.00. For payments larger than this amount, payment must be made by wire transfer.
Partial Payment
There will be NO partial payments allowed for an auction. All auctions must be paid in full according to the specified payment process. For example, you WILL NOT be able to partially pay for an auction by Credit Card and pay the remainder by another payment method, such as wire transfer. All credit card payments must be made using a single credit card.
Payment by Credit Card
Login to the Public Surplus site. Click on the My Stuff link and then click on the Past Bids link. Click on the description of the auction and then click on the Pay Online link located on the right-hand side of the screen. Follow the steps to complete the transaction. A receipt will be emailed to you once the payment has cleared.
Wire Transfers
For payments over $4,000.00, a Wire Transfer is required. If you need to do a wire transfer, please email support at buyersupport@publicsurplus.com and ask for wire instructions or request the instructions via live chat. These instructions will be emailed to you. Please follow them exactly to ensure prompt payment.
Buyer Premium: A Buyer�s Premium of 8%
will be added to the final sale price with a $1 minimum charge per auction
to collect payment. The premium will be visible during the bidding process and
will be included in the payment required.
Taxes: WSU Surplus Stores applies Destination Tax on items
purchased. Sales Tax is assessed by the county tax code location in which the
item is being sold. Sales tax will not be collected on titled equipment such as
vehicles and trailers. Sales tax on titled equipment will be paid at the time
of transferring title and registration with your local Department of Licensing.
A copy of your resellers permit must be supplied for all Washington State
businesses who wish to qualify for a tax exemption.
Shipping and Loading: WSU Surplus Stores does not arrange
shipping or provide shipping quotes. Please refer to the property location and
zip code in the listing and contact a local shipper of your choice for rates.
All shipping costs will be the responsibility of the winning bidder. Please
consider these costs when submitting your bid. With prior approval and
coordination, WSU Surplus Stores may be able to assist with loading some items
only under the condition that WSU Surplus Stores, its officers, agents, and
employees are held harmless from and against any and all losses, costs,
expenses, liabilities, claims, actions, or damages (including any attorney�s
fees and court costs) which may result from or in connection with any such
assistance provided by WSU Surplus Stores employees.
Property Removal: Unless otherwise stated in the auction listing
or permitted by special arrangement approved and coordinated through WSU
Surplus Stores, the winning bidder shall only remove the property Monday -
Friday 8:00 am - 2:30 pm PST. The winning bidder must present a copy of the
Paid Receipt and valid photo identification at the time of pick up. Should the
winning bidder elect to have another person pick up the property, a letter of
authorization must be sent to WSU Surplus Stores via email to surplus@wsu.edu
or to the auction contact on the auction listing. All industrial type equipment
used by winning bidders on WSU property to load, unload, tow, repair, modify,
etc., must meet Occupational, Safety, and Health Administration standards. Any
damage done to WSU property as a result of winning bidder�s use of any such
industrial type equipment shall be the sole responsibility of the winning
bidder and the winning bidder agrees to pay any and all costs incurred by WSU
Surplus Stores for the repair of property damaged by the winning bidder or any
person authorized by winning bidder to pick up purchased items.
Failure to Pay and or Pickup: If the winning bidder fails to pay and remove their item within the five (5) business days (or the alternate time frame noted in the listing), they will be blocked from bidding on the WSU Surplus Stores site. Blocked bidders may request a one-time reinstatement, after 30 days, if the following conditions are met:
� Titled Equipment: Payment of $100 relist fee, per vehicle, is received.
� All Other Auction Items: Payment of either a $25 fee, or 5% of the final bid amount (whichever is greater), for each abandoned lot is received.
WSU Surplus Stores reserves the right to resell an item if that item is not
removed within the timeframe allotted in these Terms and Conditions. If the
winning bidder contacts WSU Surplus Stores within the allotted timeframe, but
cannot remove the item within the allotted timeframe, a one-time pickup
extension may be granted, as determined in WSU Surplus Stores� sole discretion
at the rate of $25 a day for up to five (5) additional business days. WSU
Surplus Stores also reserves the right to have a vehicle towed, at the winning
bidder�s expense, if the purchased vehicle is not removed within the timeframe
allotted in these Terms and Conditions. Continued abuse of this policy will
result in being permanently blocked from the WSU Surplus Stores site.
Acceptance of Terms and Conditions: By submitting a bid, the bidder agrees that the bidder has read, fully understood and accepted these Terms and Conditions, and agrees to pay for and remove the property, if the bid is accepted, by the dates and times specified.
