TECHNICAL QUESTIONS
Due to the descriptions of items often being completed by personnel who may be untrained in these areas, potential bidders are advised that physical inspection of the items will be accommodated. Photos are merely representative of the vehicles and may not be relied upon for disclosure of all defects. Bidders are encouraged to inspect the vehicles prior to submitting bids.

Service records will not be given at the time of auction. If a winning bidder requests the service records, this request will be treated as a data practices request and forwarded on to our Human Resources Department to be handled in the same fashion as any other data request received by the County.

TAXES
State Sales Tax (6.875%) and Local Trans Tax (00.5%) will be added to the final sale price. These taxes will be visible during the bidding process and added to the total bid price.

Winning bidders will be required to pay any applicable taxes, unless an STE3 Form (Certificate of Exemption) is received with their payment; however, this does not apply to motor vehicle sales, as those are considered tax exempt by our agency.

PAYMENT
Winning bidders must arrive with their winning email, a valid ID, and exact payment. Payment must be received in the Purchasing Division PRIOR to pick-up of any auction item.

The successful bidder will be required to remit payment within five (5) business days from the date on the Notice of Award. Failure to make payment within five (5) business days may result in the item being awarded to the next highest bidder, if applicable.

With the exceptions of holidays, pick-up and payment time is from 9:00AM through 3:00PM CT.

PICK-UP
The winning bidder is responsible for making all arrangements and costs associated with the removal, shipping, and handling of an item.

The successful bidder will be required to REMOVE the property within ten (10) business days from the date on the Notice of Award. Failure to pick up an item within ten (10) business days may result in forfeiture of the item, as well as forfeiture of any payment made on the aforementioned item. Winning Bidder will be considered a bogus bidder and blocked from our future auctions.

If the winning item is a motor vehicle and the winning bidder intends to drive it home, proof of insurance is required at the time of pick-up. If the motor vehicle is going to be trailered, no insurance is required.

***At the sole discretion of St. Louis County, alternate pick-up options may be made. However, the winning bidder may be charged a $25.00 per day fee for storage. This fee will be payable at the time of pick-up.

ADDITIONAL DISCLAIMERS
Buyer will acquire these items USED, AS IS, WHEREIS. There are no guarantees, express or implied as to condition, usability, merchantability, or fitness for a particular purpose. It is not subject to any breach of guarantee, specifications, warranties, express or implied, as to the quality or kind of any such product. The County of St. Louis reserves the right to accept or reject any or all auction bids or any part of any auction bid.

St. Louis County is not responsible for any omissions or errors in the description of items being offered for sale. Under no circumstances will a refund or adjustment be made due to the property failing to meet buyer's expectations.

Any bidder who fails to pay for an awarded auction, or fails to pick up property that has been awarded and paid for, shall not be allowed to bid on future auctions with St. Louis County. In addition, the St. Louis County reserves the right to block bidders from participating in County auctions if they have defaulted on auctions with other public entities. Bidders will be blocked by username, registered name and registered email address. Blocked bidders shall not be allowed to bid on, pay for or pickup any auction item.

To the fullest extent permitted by law the Bidder agrees for and on behalf of bidder, bidder?s heirs, successors and assigns that the winning bidder shall indemnify and hold harmless the County and its officers, employees, and agents from and against claims, damages, losses and expenses, including but not limited to attorney?s fees, arising out of or resulting from the sale or failure to sell any item, provided that such claim, damage, loss or expense is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property, but only to the extent caused by the negligent acts or omissions of the Bidder, bidder?s heirs, successors, or anyone directly or indirectly employed by them or anyone for whose acts they may be liable, regardless of whether or not such claim, damage, loss or expense is caused in part by a party indemnified hereunder. Such obligation shall not be construed to negate, abridge, or reduce other rights or obligations of indemnity that would otherwise exist as to a party or person described herein.

St. Louis County?s Conflict of Interest policy states that officials/employees are prohibited from using privileged government data obtained through their position to further their own private interests.
