erms And Conditions for Yuma County


Guarantee Waiver:

All items sold in AS IS condition and Yuma County, hereby disclaims all warranties either expressed or implied, including implied warranty or merchantability of fitness for a particular use. All sales are final. Yuma County makes no guarantees or warranties that equipment/vehicles are in conformance with the original factory emission specifications. The description of surplus property offered for sale has been compiled from available data, but there is no guarantee or warranty on the part of Yuma County as to condition or quality. There is no warranty of vehicle odometer readings.

Description Warranty:

Yuma County warrants to the Buyer that the property offered for sale will conform to its description. Any claim for mis-description must be made prior to removal of the property. If Yuma County confirms that the property does not conform to the description, Yuma County will keep the property and refund any money paid. The liability of Yuma County shall not exceed the actual purchase price of the property. Please note that upon removal of the property, all sales are final.


Indemnification:

Bidders agree to indemnify and hold Yuma County harmless for any and all damages, claims, or liability of any nature or kind in the sale of, or the buyers use of, the property. The buyer, its predecessors, successors and assigns hereby release, relinquish and discharge Yuma County, its former, present and future agents, employees, officers, officials and legal representatives (collectively known as the County) from any liability arising out of the sale and/or concurrent negligence of the County for any injury, including death or damage to persons or property, where such damage is sustained in connection with, or arising out of, the sale of County owned property.


Inspection:

Most items offered for sale are used and may contain defects not immediately detectable. Bidders may inspect the property prior to bidding. Bidders must adhere to the inspection dates and times indicated in the item description or contact the person listed to schedule an inspection.

Auction Questions: Questions received within the last four (4) hours of the close of the auction might not be answered. All questions should be submitted in writing and answers will be posted on the auction website.


Consideration of Bid:

Yuma County reserves the right to reject any and all bids and to withdraw any of the items listed from sale. At the time the auctioneer awards sale of item to bidder, a legally binding contract is established between Yuma County and the bidder.


Notice of Award:

Successful bidders will receive a Notice of Award by email from PublicSurplus.com


Payment:

PayMac, a third-party payment processing company, receives and processes ALL payments for Yuma County. Payment for an awarded item must be received within 5 business days of close of auction. Payment shall be made online via PayPal by credit card, NO CASH, CHECK, OR MONEY ORDERS WILL BE ACCEPTED. If you choose to pay with a credit card please follow the instructions below. The credit card limit per transaction is $4,000.00. For payments larger than this amount follow the instructions listed under Wire Transfers.


Payment by Credit Card

Login to the Public Surplus site. Click on "My Stuff" and then click on "Past Bids". Click on the description of the auction and then click on "Pay Online" link located on the right hand side of the screen. Follow the steps to complete the transaction. A receipt will be emailed to you once the payment has cleared. We accept all major credit cards, PayPal and e-Checks.


Partial Payment

There will be NO partial payments of an auction allowed. All auctions must be paid in full per payment process used per auction. For Example: You WILL NOT be able to pay partially for an auction by Credit Card and pay the remainder by another payment method such as a wire transfer.


Wire TransfersWire transfer payment is required for all transactions $4000 or more.

1. If you need to do a wire transfer, please go to "Help" and select the help topic "Wire Transfers. This will provide you with the instructions required to do a wire transfer payment. You must be logged into the site in order to get this help topic. You may also use the "Chat" option to allow Public Surplus Buyers Support to work out the details for this transaction.

2. Public Surplus will notify you upon receipt of payment. You may then contact the responsible party listed for that item and arrange for a mutually convenient pick up time. You will need to bring the payment receipt or the auction item(s) will not be released to you.


Bid Deposits:

Yuma County may require bid deposits in order to ensure fairness and equity to all buyers as a way to decrease default bidding. The deposit will be reversed if no default occurs or the bidder does not win the auction. Public Surplus will collect and retain the deposit if there is a default by the winning bidder.

Buyers Premium:

A 10% Buyer Premium will be added to the final sale price with a $1 minimum charge per auction to collect payment.


Buyers Certificate: Successful bidders will receive a Notice of Award by email from Public Surplus.

State/Local Sales and/or Use Tax: Not applicable


Removal:

All items must be removed within 10 working days from the time and date of issuance of the Notice of Award from Public Surplus. Purchases will be released only upon receipt of payment as specified. Successful bidders are responsible for loading and removal of any and all property awarded to them from the place where the property is located at various locations and obtaining any necessary paperwork. The buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Care will be taken to not damage County property during the removal process. Property may be removed by appointment based on the availability of appropriate County staff, or otherwise by appointment only between the hours of 8:00 am and 3:00 pm, Monday through Friday, excluding legal holidays. Vehicle Titles:

Yuma County will issue a title or certificate upon receipt of payment. Titles may be subject to any restrictions as indicated in the item description on the website. Open titles cannot be issued. Yuma County will not issue replacement titles.


Default:

Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or, (3) failure to remove all items within the specified time. Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, Yuma County may exercise such rights and may pursue such remedies as are provided by law.


Applicable Law:

Although this site may be accessed from any state, bidders who participate in this auction agree that the laws of the State of Arizona shall govern all matters relating to the use of this auction and purchase of items listed by Yuma County on this site.


Privacy:

Yuma County gathers information from bidders so that it will know who has won an auction item. Personal information is not sold or rented. Personal information is used for the purpose of conducting online auctions and not used for any other purpose.


Acceptance of Terms and Conditions:

By submitting a bid, the bidder agrees they have read, fully understand and accept these Terms and Conditions, and agree to pay for and remove the property, if the bid is accepted, by the dates and times specified.
