TERMS AND CONDITIONS
FOR ONLINE SALES
CITY OF BOZEMAN

Guarantee Waiver.
All property is offered for sale AS-IS, WHERE-IS. The City of Bozeman (Montana) makes no warranty, guarantee, or representation of any kind, expressed or implied, as to the usability, merchantability or fitness for any purpose of the property offered for sale. The Buyer is not entitled to any payment for loss of profit or any other money damages including, but not limited to, special, direct, indirect, or consequential damages.
No Description Warranty. The City of Bozeman is not responsible for any omissions or errors in description of items being offered for sale. It shall be the bidder's responsibility to inspect and satisfy him or herself as to the details and conditions of the item offered before entering a bid. The Agency does not attest to the authenticity of any item.
Inspection.
Most items offered for sale are used and may contain defects not immediately detectable. Bidders may inspect the property prior to bidding. Bidders must adhere to the inspection dates and times indicated in the item description or contact the person listed to schedule an inspection.
Consideration of Bid.
The City of Bozeman reserves the right to reject any and all bids and to withdraw from sale any item(s) listed.
Notice of Award.
Successful bidder will receive a Notice of Award by email directly from PublicSurplus.com.
Auction Surcharge.
The bidder is responsible for payment of the 7% surcharge assessed on all purchases. The surcharge will be visible during the bidding process and will be included in the payment required.
Payment.
Payment in full is due no later than five (5) business days from the date of issuance of the Notice of Award. Payment shall be in the form of Cashiers Check, Certified Check, or Money Order made payable to the City of Bozeman. Payment shall be made at, or to, the location listed in the Notice of Award.
Removal.
All items must be removed within ten (10) business days from the date of issuance of the Notice of Award. Purchases will be released only upon receipt of payment. The location of the property is indicated both on the website and in the Notice of Award. The Buyer will make arrangements and perform all work necessary for removal of the property. This includes packaging, loading and transporting of the property. Under no circumstances will the City of Bozeman assume responsibility for packaging, loading, or shipping of awarded property. Property may be removed by appointment only.
Vehicle Titles.
The City of Bozeman is in possession of all vehicle titles. Equipment Manufacturer Statement of Origin are available unless otherwise stated in the description. A Bill of Sale will be provided, along with the title, showing transfer of ownership to the individual, business or government entity specified by the Buyer. Open titles will not be given out. The Purchaser section of the title must be completed. The City of Bozeman will not issue replacement titles.
Default.
Default shall include:
- Failure to observe these terms and conditions
- Failure to make good and timely payment
- Failure to remove all items within the specified time.
Default may result in termination of the contract and Buyers suspension from participation in all future sales, until the default has been rectified. If the Buyer fails in the performance of their obligations, the City of Bozeman may exercise such rights and may pursue such remedies as are provided by law.
Acceptance of Terms and Conditions.
By submitting a bid, the bidder agrees that they have read, fully understand and accept these Terms and Conditions for Online Sales. Bidder agrees to pay for and remove the property, if the bid is accepted, by the dates and times specified.
