Auction Provisions:
1. Rules of the Sale -All property is Sold As-Is/Where-Is without any warranty whatsoever expressed or implied. The description given is based on the best available information, but Western Washington University makes no guaranty, warranty, or representation expressed or implied as to the quantity, kind, character, size quality, weight or description of any property, or its fitness for any use or purpose. Furthermore, no claim shall be considered for allowance or adjustment or for rescission of the sale based on failure to inspect the property. Western Washington University reserves the right to accept or reject any and/or all bids when found to be in the best interest of the state of Washington. Failure to purchase items awarded, will result in a permanent ban from future auctions. Your account will be locked out.
2. All purchases must be picked up within ten (10) days at our Commissary Warehouse located at 781 25th Street, Bellingham, Washington, 98225-9116. The buyer must arrange pickup, insurance, and delivery with a carrier of their choice. We will not be responsible for items after they leave our premises.
3. Reserve auction items: When you are bidding in a "Reserve Price Auction". A reserve price is the lowest price a seller is willing to sell the item for. The reserve price is usually higher than the minimum starting bid and is kept secret from buyers before and after the bid closing. Sellers use reserve price to stimulate interest in their item and to establish a threshold for which they may withdraw their item from the auction for any number of reasons. Always be aware that if you bid in a reserve price auction and your bid does not meet the reserve, you have no obligation to purchase the item from the seller, nor is the seller obligated to sell his item to the high bidder.
4. Proxy bids are when you place the maximum amount that you are willing to pay for an auction and Public Surplus automatically increases the amount of your initial bid for you in set increments. An example of this would be a TV is being sold that you want to bid on. It currently is listed at $60.00 with an increment level of $5.00. You decide that the maximum amount you could pay is $100.00. The proxy bid will set your first bid at $65.00 so that you are the winning bidder. If someone else comes in and bids higher - say $75, then the proxy bid will automatically increase your bid amount to $80.00. It will continue doing this until it reaches your maximum bid amount - $100.00. Proxy bids are very useful for when you don't want to have to watch an auction continually to win it.
5. A Dutch Auction is an auction in which the seller lists multiple quantities of an identical item. With multiple items up for sale, multiple bidders can win. Also, one bidder can try to buy more than one quantity. If there are more bidders than items, the highest bidder will receive their full quantity. Bidders may receive partial quantities - i.e. only receive 2 out of the 3 items they bid for. All winning bidders pay his or her exact high bid.
6. Payment Information: Payment is required within five (5) days of the close of the auction. State of Washington and local Sales Tax will be collected according to Washington law. The current rate is 8.7%. A 7% buyer's premium will be charged to the winning bidder at time of payment.
7. Eligibility to Bid: This auction site is only available to people who are legally able to form binding contracts as the buyer of an auction item. Persons who are under the age of 18 are not eligible for membership. If you do not meet these requirements, you are not eligible to use these auction services.
8. Identification Required: Our policies require valid government picture identification to purchase items sold through this auction (even if paying cash).
9. Viewing of Items: You may schedule an appointment ((360) 650-3566 or 3546) to view items for sale weekdays from the hours 8:00AM to 4:00PM at WWU Commissary warehouse, 781 25th Street, Bellingham, Washington, 98225-9116.
General Provisions:
1. Each bid is received indemnify the understanding that the acceptance by WWU of the offer to purchase any or all of the items described therein shall constitute a contract between the bidder and WWU. In event of default by the bidder, WWU reserves the right to sell or otherwise dispose of the items through other means, and hold the bidder liable for any excess cost, lost revenues or expenses occasioned thereby.
2. WWU hereby informs the Bidder/Purchaser that there may be risk of bodily injury or damage to property in regard to the use or operation of equipment, machinery and/or other items obtained under sealed bid and as WWU has no control over such use or operation, the Bidder/Purchaser agrees to release and hold WWU harmless from any and all liability for any losses arising out of the use or operation of the purchased item(s) by the Bidder/Purchaser and/or any other third party.
3. Assumption of Liability: The purchaser shall assume all liability for the property after award is made. WWU will exercise its usual care for protection up to the time of removal, but will not be responsible for any loss or damage.
4. Unless otherwise noted, all sale items are to be paid for within five (5) and picked up within ten (10) calendar days of auction close. WWU reserves the right to award any item to a succeeding bidder, should highest bidder fail to pay for and remove from WWU property within the prescribed time period contained herein.
5. Acceptable forms of payment include cash, cashier's check, money order, Visa. MC, Discover or other form of guaranteed payment. Personal checks with picture government ID will be accepted. Information required to be provided at the time of payment will include your name and address. Additional information may be required under certain circumstances including purchases in excess of $10,000. This additional information may include, but is not limited to, your taxpayer identification number (or social security number) and proof of identity. State of Washington and local sales tax will be collected according to Washington Law
6. Except as stated herein, no service of any kind will be furnished by WWU, and the bidder shall assume all cost of removing property from the site
7. We are able to package or palletize most items for nominal fees and will stage items for your shipper. Please call for an estimate 360-650-3566. You must arrange for delivery and insurance with a carrier of your choice. We are not responsible for items after bidder takes possession.
8. A receipt will be provided to the bidder at the time property is picked up and any required identification or purchase information by law or policy must be provided.
9. Applicable Law and Courts: Any contract resulting from this solicitation shall be governed in all respects by the laws of Washington and any litigation with respect thereto shall be in Washington. The contractor shall comply with applicable federal, state and local laws and regulations.
10. Information gathered is used for the purpose of conducting the auction sale and will not be used for any unrelated purpose. Personal information will not be released to any other party, except as required by law.
