City of Shoreview, MN - On-Line Auction Terms and Conditions
Online auctions are open to the general public, unless otherwise stated in the auction description. Buyer must be of legal age to enter into a contract with the City of Shoreview. Note: City Officials, Board Members, City Staff and immediate families are prohibited to bid or purchase surplus supply, material or equipment.
Guarantee Waiver. ALL SALES ARE FINAL. There are no refunds or exchanges. All auction items are offered "AS IS, WHERE IS." City of Shoreview makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the item offered for sale. Buyer is not entitled to any payment for loss of profit or any other money damages - special, direct, indirect, or consequential.
Description Warranty. City of Shoreview (therein referred to as: City)warrants to Buyer that the auction item offered for sale will conform to its description. Any claim for mis-description must be made prior to removal of the auction item. If City confirms that the auction item does not conform to the description, City will keep the auction item and refund any money paid. Liability of City shall not exceed the actual purchase price of the auction item.
Inspection. An auction item description has been included to assist in identifying the sale item. Presently available information has been compiled by the City and is not warranted to be accurate. Most items offered for sale are used and may contain defects not immediately detectable. Prior to bidding, bidders are strongly encouraged to inspect the auction item to verify the accuracy of the described item information. Bidders must adhere to the inspection dates and times, indicated in the item description, or contact the person listed to schedule an inspection at 4600 Victoria Street North, Shoreview MN. The City is not responsible for any omissions or errors in the description and condition of the auction item.
Bidders should note that not all auction items will have the option to be inspected. Caution should be taken to review the item description, submit accurate questions to the auction contact and research the item prior to submitting a bid.
Consideration of Bid. City reserves the right to reject any and/or all bids considered. City also reserves the right to withdraw an item at any time, including during the bidding process.
Notice of Award. Successful bidders will receive a Notice of Award, by e-mail, from PublicSurplus.com.
Payment. PayMac, a third-party payment processing company, receives and processes all payments for City of Shoreview. Payment for an awarded item must be received within two (2) days after the Notice of Award of the successful bid.
Payment may be made on-line by credit card or by wire transfer. Cash, checks, cashier checks and money orders will not be accepted. Credit card instructions follow below. Credit card limit per transaction is $10,000.Payments larger than $10,000 should follow instructions listed under Wire Transfers.

Follow the steps to complete the transaction.
A receipt will be e-mailed once payment has cleared.
Payment by Wire Transfers.
For payments over $10,000, wire transfers are required.
E-mail support at buyersupport@publicsurplus.com for wire instructions or request the instructions via live chat. Follow instructions exactly to allow for prompt payment. Wire transfers can take up to 2 business days to be received and posted. Do not attempt to pick-up your item until you have received notification that the wire transfer has been received.
Partial Payment. Partial payments are not allowed. All auctions must be paid in full according to the specified payment process.
Pick-Up Procedures. Once notified upon receipt of payment, contact the responsible party listed for the auction item and arrange for a mutually convenient pick-up time. Bring to the pick-up time and location:

Along with a note from the designated "winning bidder"-specifically naming you as an authorized representative,
Winning bidder must send an e-mail from the winning bidder's e-mail address, used for the auction, stating that you are authorized to pick-up the item.
Bid Deposits. City may require bid deposits, in order to ensure fairness to all bidders. The deposit will be reversed if no default occurs or the bidder does not win the auction. The deposit will be retained if the winning bidder defaults. If added, the deposit will be visible during the bidding process and will be included in the payment required.
Buyers Premium: A Buyers Premium will be added to the final sale price with a $1 minimum charge, per auction item, to collect payment. If added, the premium will be visible during the bidding process and will be included in the payment required.
State/Local Sales and/or Use Tax. City may collect sales tax, unless Buyer has provided a valid tax-exempt certificate to City prior to payment. If applicable, sales tax will be visible during the bidding process and included in the payment required.
Removal. Upon payment, buyer must remove auction item(s) from the City premises located at 4600 Victoria Street North, Shoreview MN within five(5) business days after the time and date of issuance of the Notice of Award. If the Buyer, after making payment for an item, fails to remove the item within the specified time, the City reserves the right:
1. To retain all payments; and
2. To dispose of the item through another auction or otherwise.
Successful buyers are responsible for furnishing all arrangements, labor, packing, loading, equipment, removing, transporting and performing all work necessary of auction item awarded to them, from the place where the auction item is located, as indicated on the website, and in the Notice of Award. No maintenance is allowed on City property. Under no circumstances will City staff assume responsibility for packing, loading, transporting or trouble-shooting purchased items.
Auction item may be removed, upon appointment, between work hours of 8:00 am and 3:00 pm, Monday through Friday, excluding legal holidays.

Vehicle Titles. City will issue a title or certificate upon receipt of payment. Titles may be subject to any restrictions as indicated in the item description on the website. Open titles cannot be issued. City will not issue replacement titles.
Default. Default shall include:
1. Failure to observe these terms and conditions;
1. Failure to make good and timely payment; or
2. Failure to remove auction items within the specified time.
Default may result in termination of the bid contract and suspension from participation in all future sales until the default has been cured. If Buyer fails in the performance of their obligations, City may exercise such rights and may pursue such remedies as are provided by law.
Acceptance of Terms and Conditions. By submitting a bid, bidder agrees for and on behalf of bidder, bidders heirs, and successors and assigns that bidder shall indemnify and hold the City harmless from and against any claim, demand or cause of action arising or alleged to have arisen out of the auction sale or failure to sell any item of surplus auction item including claims for personal or bodily injury, death or contract damages.
The bidder agrees he has read, fully understood and accepted these Terms and Conditions of Online Sales, and agrees to pay for and remove the auction item, if the bid is accepted, by the dates and times specified.
Bidder Disqualification. City reserves the right to disqualify and block bidders submitting frivolous bids. Bidders may also be disqualified from bidding due to late payment, failure to remove sold items as directed, incomplete and/or inaccurate registration information or any behavior deemed disruptive of the auction process. Bid deposits will be forfeited should the bidder default on a specified auctions(s) due to non-payment.
