Guarantee Waiver:
All property is offered for sale "as-is, where-is." The Arizona Department of Transportation (ADOT) makes no warranty, guarantee or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. The Buyer is not entitled to any payment for loss of profit or any other money damages - special, direct, indirect, or consequential.
Description Warranty:
The description of property offered for sale has been compiled from available data and there is no guarantee or warranty on the part of ADOT as to number, condition, or quality of property offered. Refunds or adjustments will not be made. Verbal comments by custodians of the property concerning the condition of property are not considered by ADOT, nor will they be grounds for disputing an award of property. If property purchased is equipment to be handled or driven and could possibly cause injury, no matter how remote, you are urged to have the equipment inspected by a qualified individual prior to driving or using the equipment.
Inspection:
Most items offered for sale are used and may contain defects not immediately detectable. ADOT does not provide or allow for pre-inspection of vehicles and equipment. Maintenance records are not available.
It is the buyer's responsibility to check for safety and other types of recalls. For your own safety, buyers should always check for manufacturer recalls prior to purchasing and/or operating any vehicle or type of equipment sold. To check for recalls click the NHTSA link below:

Consideration of Bid:
ADOT reserves the right to reject any and all bids and to withdraw from sale any of the items listed. Further, "An employee of the owning or disposing agency shall not directly or indirectly purchase or agree with another person to purchase surplus property if that employee is or has been directly or indirectly involved in the purchase, disposal, maintenance or preparation for sale of surplus property." (Arizona Administrative Code R2-15-303.E.5)
Notice of Award:
Successful bidders will receive a Notice of Award by email from PublicSurplus.com.
Payment shall be made within 5 business days after award
Payment is accepted online through the payment portal or by wire transfer only. In-person payments are no longer accepted as of 01/18/2024.
Payment Methods:
Accepted forms of payment are Wire Transfers and US Credit/Debit Cards only (ADOT does not accept cash, checks, or money orders). Bank wire transfer information will be provided to the winning bidder upon request via email at FleetAuction@azdot.gov.
The following US credit cards are accepted for payment: Visa, MasterCard and Discover. Beginning September 29, 2025, a $2.00 or 2.2% (whichever is greater) processing fee will apply to all credit/debit transactions.
Third (3rd) party payments are not accepted on any auctions. The winning bidder is required to provide payment, if a third party payment is submitted that will result in default of the bidder/auction.
Sales Tax:
Sales tax is not included in the bid price. A transaction privilege tax of 6.3% will be applicable to all sales unless a current resale/business license and completed AZ5000/AZ5000A form (provided on the auction page) is supplied.
Removal:
No property may be removed by the successful bidder or authorized transporter prior to full payment of the purchase price being received. ADOT cannot be held responsible for late payments.
ADOT will notify you upon receipt of payment. You may then contact the responsible party listed for that item and arrange for a mutually convenient pick up time. Please bring the payment receipt or the auction item(s) may not be released to you.
Buyer must remove auction item(s) from premises within 5 business days of receipt of payment or within 10 business days from the time the auction ended. Successful bidders are responsible for the loading and removal of any and all property awarded to them from the place where the property is located, as indicated on the website and in the Notice of Award. The Buyer will make all arrangements and perform all work necessary, including packing, loading, securing and transportation of the property. Under no circumstances will ADOT assume responsibility for packing, loading, securing or shipping. Vehicles that are listed as 'tow only' must be removed by a professional flatbed tow truck only. Property may be removed between the hours of 8am and 3pm, Monday through Friday, excluding legal holidays. Third Party Removal:
If other than the successful bidder is picking up the item, they will need:
* A copy of the receipt showing the item was paid (photo copies are acceptable)
* ADOT release form (provided on the auction page) from the successful bidder specifically naming the person/company as their authorized representative, along with a color copy of the successful bidders valid drivers license.
Vehicle Titles:
ADOT will issue a lien-free title or certificate when the property is removed. Titles may be subject to any restrictions as indicated in the item description on the website. Open titles cannot be issued. ADOT will not issue replacement titles.
Default:
Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all items within the specified time. Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, ADOT may exercise such rights and may pursue such remedies as are provided by law.

Acceptance of Terms and Conditions:
By submitting a bid, the bidder agrees that they have read, fully understand and accept these Terms and Conditions of Online Sales, and agree to pay for and remove the property, if the bid is accepted, by the dates and times specified.
