1. QUALIFIED BIDDERS / RESTRICTIONS
A. MINORS PROHIBITED
Bidders must be 18 or older to participate in the auction and must provide factual personal information.
B. SEIZED AND FORFEITED PROPERTY
Arizona Revised Statutes 13-4315 prohibits the following employees and other persons from bidding, winning or otherwise purchasing seized and forfeited property: City of Show Low Police department employees, any person who participated in the seizure/forfeiture of the property being auctioned, employees associated with the operation of the auction, and any member of the immediate family of any of these employees or persons.
2. INSPECTION OF PROPERTY
All property will be available for inspection Monday through Friday from 8:00 a.m. to 3:30 p.m. with the exception of holidays. The property will be available for inspection at the Public Works yard at 1281 E. Thornton Road in Show Low unless otherwise stated in the property description of the Invitation. Bidders are advised and encouraged to carefully inspect any property offered in the Invitation prior to submitting a bid. Failure to inspect the property shall not constitute grounds for a claim against the City or for the withdrawal of a bid after the auction's close.
3. CONDITION OF PROPERTY
All property listed for sale is sold "AS-IS". The City of Show Low expresses or implies no warranty as to quality, kind, completeness or condition of any property offered in the Invitation, or its fitness for any use or purpose.
In the case of vehicles or equipment, the successful bidder assumes all liability for the operation, transport and/or use of the vehicles or equipment. Any needed repair becomes the responsibility of the successful bidder following the purchase of said equipment.
4. PAYMENT OPTIONS AND RESPONSIBILITIES
Payment. PayMac Inc, a third-party payment processing company receives and processes all payments for the City of Show Low. Payment for an awarded item must be received within 5 business days of close of auction. Payment shall be made online by credit card, or wire transfer. If you choose to pay with a credit card please follow the instructions below. The credit card limit per transaction is $4,000.00. For payments larger than this amount follow the instructions listed under Wire Transfers.
Payment by Credit Card
Login to the Public Surplus site. Click on "My Stuff" and then click on "Past Bids". Click on the description of the auction and then click on "Pay Online" link located on the right hand side of the screen. Follow the steps to complete the transaction. A receipt will be emailed to you once the payment has cleared.
Partial Payment
There will be NO partial payments of an auction allowed. All auctions must be paid in full per payment process used per auction. For Example: You WILL NOT be able to pay partially for an auction by Credit Card and pay the remainder by another payment method such as a wire transfer.
Wire Transfers:
For payments over $4,000.00 a Wire Transfer is required. NO CASH, CHECKS, OR MONEY ORDERS WILL BE ACCEPTED. If you need to do a wire transfer please email support at buyersupport@publicsurplus.com asking for wire instructions or request the instructions via live chat. These instructions will be emailed to you. Please follow them exactly to allow for prompt payment.
Pick Up Procedures
1. Public Surplus will notify the Buyer upon receipt of payment. The Buyer may then contact the responsible party listed for that item and arrange for a mutually convenient pick up time. The Buyer must bring the "Notice of Award" with the "Paid Receipt" and personal identification such as a Drivers License or DMV ID to the pick up location. The person releasing the item will require the Buyer to show all three documents. The Buyer must present these forms of identification at the scheduled pick up or the auction item(s) will not be released.
2. If you are picking up an item for someone else, you will need to bring the receipt, (photo copies are acceptable), plus a note from the designated "winning bidder" specifically naming you as their authorized representative, along with your own ID.
Bid Deposits. City of Show Low may require bid deposits in order to ensure fairness and equity to all buyers as a way to decrease default bidding. The deposit will be reversed if no default occurs or the bidder does not win the auction. Public Surplus will collect and retain the deposit if there is a default by the winning bidder.
Buyers Premium: A 10.0% Buyer Premium will be added to the final sale price with a $1 minimum charge per auction to collect payment.
State/Local Sales and/or Use Tax. City of Show Low will collect sales tax, currently 9.10%, on non-vehicles if applicable, unless the buyer has provided a valid tax-exempt certificate to The City of Show Low prior to payment.
5. TITLE
Ownership to personal property will be transferred to the purchaser after full and final payment is made. Additionally, possession of vehicles shall not occur until the Arizona MVD Certificate of Title has been duly signed and is delivered to the purchaser simultaneously with the vehicle. Vehicle titles will be available no earlier than 3 business days following the close of the auction.
6. REMOVAL OF PROPERTY
Property will be made available for pick up on the second business day after the auction closes. The successful bidder may remove the property upon full payment of the quoted bid price and administrative fees when applied. All property must be removed within eleven (11) working days of the auction's close. Exceptions can be granted for circumstances beyond the purchaser's control such as, but not limited to severe weather conditions. Proof of payment is necessary before any property will be delivered to your possession. The purchaser is responsible for all transportation arrangements. Items purchased will be released only to the purchaser or an authorized representative. The representative must provide written authorization from the purchaser before any property will be released to them.
Surplus property will be available for removal from the Show Low Public Works yard located at 1281 E. Thornton, unless otherwise specified in the Invitation. Property may be removed Mon-Fri from 8:00 a.m. to 2:30 p.m. except on holidays. The City of Show Low will assist in loading the property in or onto the purchaser provided transportation.
It is the purchaser's responsibility to comply with the applicable Federal, State and local laws, ordinances and regulations regarding registration, licensing, handling, possession, transportation, sale, use or disposal of the property listed in the Invitation. Purchasers or users of the property are not exempt from violation of such laws because the City of Show Low is party to this sale or had any interest in the property at any time.
7. DEFAULT
If, after the award, the Purchaser breaches this contract by: a) failure to furnish full and final payment within the time allowed in this invitation, or b) failure to remove the property within the time allowed in this invitation, the purchaser shall lose all right, title, and interest which they might otherwise have acquired in and to such property as to which a default has occurred. If default occurs, the City of Show Low may in its discretion award interest in an auction item to the next highest bidder.
Acceptance of Terms and Conditions. By submitting a bid, the bidder agrees that they have read, fully understand and accept these Terms and Conditions of Online Sales, and agree to pay for and remove the property, if the bid is accepted, by the dates and times specified.
