Terms and Conditions for Accepting Surplus Property Sold by Solano County

 

The terms and conditions herein are the complete and exclusive statement of the terms of any property sold by Solano County. Your bid confirms your assent to these terms and conditions. No addition to or modification of any of these terms and conditions will be effective unless agreed to in writing by Solano County.

 

Property - Any reference to ?Property? herein shall be construed to mean surplus/used equipment owned by the County.

 

Guaranty Waiver - All assets are offered for sale ?AS IS, WHERE IS? basis with all faults, latent and patent. Solano County (Seller) makes no warranty, guaranty, or representation of any kind, expressed or implied, as to nature, quality, or condition of the property, included, but not limited to, any implied warranties or the merchantability and/or fitness for any purpose or non-infringement, or otherwise, of the property offered for sale. The Buyer is not entitled to any payment for loss of profit or any other money damages ? special, direct, indirect, or consequential.

 

Warranties - Seller warrants to the Buyer the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the Seller shall not exceed the actual purchase price of the property. Please note upon removal of the property, all sales are final.

 

Consideration of Bid - Seller reserves the right to reject any and all bids and to withdraw from sale any of the assets listed at any time until the Seller has received payment in full for the assets and Buyer has removed the assets from the Seller's premises in their entirety.

 

Payment - Payment is due in full no later than 10 business days from the time and date of the close of the auction. Payment must be made at the time of removal (see Removal for terms). Payment methods for all auctions items are debit or credit cards (Visa, Mastercard, Discover) only. Solano County does not accept cash or check as an acceptable form of payment. Solano County is not accepting cash, money orders, cashier?s checks, personal or business checks.

 

State/Local Sales and/or Use Tax - Buyers are subject to State and/or local sales and/or use tax unless they provide a proper State of California exemption certificate. California is not a reciprocity state; therefore all permits must be issued by the State of California and will be verified.

 

Buyer?s Premium & Additional Fees - All sales subject to a Buyer?s Fee and/or transaction fee, as imposed by PublicSurplus.com, (expressed as a percentage of the final selling price or a specified amount) will be added to the final selling price of all items in addition to any taxes imposed.

 

Removal - Property may be removed appointment only and appointments must be made at least 24 hours in advance. All assets must be removed within ten (10) business days from the time and date of the close of the auction. Purchases will be released only upon receipt of payment as specified.

Successful buyers are responsible for loading and removal of any and all property awarded to them from the place where the property is located as indicated on the website.? The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Solano County shall have no responsibility for packing, loading, shipping, installation, warranty, maintenance, engineering changes or technical support of the property purchased hereunder. ?No assistance will be provided by Solano County staff in lifting or loading items into Buyer?s vehicle. Solano County shall have no responsibility for the disassembly and removal of property from Solano County?s location, unless Solano County informs you otherwise in writing.

We do not ship items. We do not accept any pre-paid shipping labels. If you are unable to pick up your auction winnings in person, you may email our department at surplus@solanocounty.com and specify a family member or friend to pick up the item for you, or, you may hire a courier/freight company to pick up, pack, and ship the item to you. 

If you require a courier/freight company to pick up your auction winnings, please note that 1) you must reach out to the Auction Contact and inform them of this before doing any pickup scheduling, and 2) we are unable to put items in boxes, or secure them to pallets, so the courier/freight company you chose must be able to do that themselves if needed, this includes provide your shipment with the necessary pallet or boxes. If in doubt, please contact the Auction Contact for more information.

 

Default - Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all assets within the specified time. Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, Seller may exercise such rights and may pursue such remedies as are provided by law. Seller reserves the right to reclaim and resell all items not removed by the specified removal date.

Solano County operates on a strike system for default. Should the buyer default one or two times, buyer will be marked as such in the system with a note that buyer failed to meet the terms and conditions of the auction and seller will reclaim and resell all items.

First Strike: Should the buyer default a third time, buyer will be placed on a three (3) month block from bidding on any Solano County auctions, seller will reclaim and resell all items.

Second Strike: Should the buyer be reinstated and default again, the buyer shall be placed in a nine (9) month block from bidding on any Solano County auctions, seller will reclaim and resell all items.

Third Strike: Should the buyer be reinstated and default again, the buyer shall be permanently blocked from bidding on any Solano County auctions, seller will reclaim and resell all items.

 

Permits and authorizations required by law - You represent that you possess all the necessary permits and authorizations required to disassemble, remove, transport or otherwise properly dispose of the property being acquired. You agree to comply with all applicable Federal, State, and local laws, regulations and ordinances, including but not limited to the regulations of the Unites States Department of Commerce relating to the export of technical data, insofar as they relate your performance.

 

Acceptance of Terms and Conditions - By submitting a bid, the bidder agrees they have read, fully understand and accept these Terms and Conditions, and agree to pay for and remove the property, by the dates and times specified. These Terms and Conditions are available for review at the top of each page of each asset listed on PublicSurplus.com. Specific Instructions (Payment, Removal, and Special) appearing on the asset page will override certain sections of these Terms and Conditions.

 

Sales to Employees - Employees of the Seller may bid on the property listed for auction, so long as they do NOT bid while on duty. Any officer, agent, or employee of the County that is responsible for surplus declarations, has privileged information regarding the item/equipment or the value thereof, that is not available to all prospective bidders, or is assigned to the organization having custody of the surplus property shall not directly, or indirectly, submit a bid or purchase surplus personal property.

 

Return of property to Solano County - There are NO returns, exchanges, or refunds.
