No Description Warranty: The Lakes Area Police Department is not responsible to any omission or errors in description of items being offered for sale. It shall be the bidders responsibility to inspect and satisfy him/herself as the details and conditions of the items offered before entering a bid. The Lakes Area Police Department does not attest to the authenticity of an item.
Inspection: Most items offered for sale are used and may contain defects not immediately detectible. Bidders may inspect the property prior to placing a bid. Inspections are by appointment only. Please contact the Lakes Area Police Department to schedule an appointment for inspection 651.257.0622.
Consideration of bid: The Lakes Area Police Department reserves the right to reject any/all bids and to withdraw from sale any items listed before the notice of award has been delivered.
Reserve Requirement: If there is a reserve requirement and the reserve price has not been met by the close of the auction, the Lakes Area Police Department reserves the right to sell the auctioned item to the next highest bidder, relist the items or otherwise dispose of the item at the agency’s discretion.
Notice of Award: Successful bidders will receive a “Notice of Award” via email from PublicSurplus.com
Payment: PayMac, a third-party payment processing company, receives all payments for Lakes Area Police Department. Payment for an awarded item must be received within five (5) business days after the date posted on the “Notice of Award” notification.
Load-out procedure:
Upon receipt of payment, you be notified via email sent to the email address you provided at the time of registration with PublicSurplus.com. You must then contact Lakes Area Police Department to arrange a mutually convenient load-out date and time. Load-out will be done by appointment only. You must present (1) the Notice of Award, (2) the Paid Receipt and (3) personal picture identification. You must present all three of the above mentioned documents at the time of load-out or the item will not be released.
If you are picking the awarded item up for someone else, you will need to bring the above mentioned documents in addition to a note from the winning bidder specifically name you as an authorized representative stating you are authorized to claim the property on their behalf.
Shipping: The Lakes Area Police Department will not ship any items. However, you my contact a local carrier of your choice to pick-up, pack and/or ship your items for you. It will be your responsibility to follow the “third-party” load-out procedures to ensure your item is released.
Bid Deposits: The Lakes Area Police Department may require bid deposits in order to ensure fairness to all bidders. The deposit will be reserved if no default occurs or the bidder does not win the auction. The deposit will be retained by the Lakes Area Police Department in the event the winning bidder defaults.
Buyer Premium: A buyer premium of 10.5% will be added to the final sale price with a $1.00 minimum charge per auction to collect payment. The premium will be visible during the bidding process and will be included in the payment required.
Load-out/removal: Buyer must remove auctioned item(s) from the Lakes Area Police Department within ten (10) business days following the date/time of the issuance of the Notice of award. If the buyer, after making payment for the auctioned item(s), fails to remove the item(s) within the specified time, the Lakes Area Police Department reserves the right to (1) retain all the payments, and (2) dispose of the item through another auction or otherwise.
Successful bidders are responsible for packing, loading, removing and transporting all property awarded to them from the place where the property is located and as indicated on the website and on the Notice of Award.
The buyer must make all arrangements and perform all work necessary, including packing, loading and transportation of the awarded property. Under no circumstances with the Lakes Area Police Department assume responsibility for packing, loading transportation of auctioned item(s).
The buyer shall be liable and reimburse the Lakes Area Police Department for any damage to Lakes Area Police Department property caused by the buyer and/or the buyer’s agent during the removal of the auctioned item(s) during the load-out process. No maintenance is to be performed on the Lakes Area Police Department property.

Risk of Loss: In the event the auctioned item is lost or destroyed after the Notice of Award has been issued, but prior to the removal and to the extent that such loss or destruction was not caused by the buyer or an agent of the buyer, the Lakes Area Police Department will refund any money paid towards the item. The liability of the Lakes Area Police Department shall not exceed the actual purchase price of the property.
Vehicle Titles: The Lakes Area Police Department will issue a title and/or certificate for the vehicle upon receipt of payment unless otherwise noted in the auction details. The Lakes Area Police Department will not issue replacement titles.
Default: Default shall include (1) failure to observe these terms and conditions, (2) failure to make good and timely payment(s) or (3) failure to remove all items within the specified date and time. Default may result in the termination of the bid contract and suspension from participation in all future sales until the default has been cured. If the buyer fails in the performance of their obligations, the Lakes Area Police Department may exercise such rights and pursue such remedies as are provided by law.
Acceptance of Terms and Conditions: By submitting a bid, the bidder agrees that he/she has read, fully understands and accepts these terms and conditions for online sales and agrees to pay for and remove the awarded property by the dates and times specified.
