?The City? in these terms in conditions refers to The City of Scottsdale and/or its employees.
Guarantee Waiver
All property is offered for sale "as-is, where-is." The City makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. The Buyer is not entitled to any payment for loss of profit or any other money damages - special, direct, indirect, or consequential. The city does not attest to the authenticity of items. Bidders buy at their own risk.
Bid rejection/Item Withdraw.
The City reserves the right to reject any and all bids and to withdraw from sale any of the items listed.
Payment
Payments are conducted through Public Surplus. The City cannot receive payments for auction items locally. Please pay for your auction before traveling to the City?s warehouse. Payment may only be made online by credit card, or by wire transfer.
Payment and pick up must occur within seven (7) calendar days after notification of award. Failure to comply may result in being blocked from all future auctions.
Payment by Credit Card
Login to the Public Surplus site. Click on "My Stuff" and then click on "Past Bids". Click on the description of the auction and then click on the "Pay Online" link located on the right-hand side of the screen. Follow the steps to complete the transaction. A receipt will be emailed to you once the payment has cleared that must be presented at time of pickup.
Wire Transfers:
A wire transfer is required for payments over $4,000.00. Instructions will be emailed to you. Please follow them exactly to allow for prompt payment.
Pickup
Items must be picked up locally by the auction winner or an authorized third party. Person picking up must be 18 years or older.
Auction winner is responsible for bringing appropriate manpower, load securing equipment, and appropriate transport vehicle. The City will cease an item pickup if it is deemed unsafe.
Current pickup hours are Monday - Friday, 7am ? 1:30pm. Some auctions will require the auction winner to call ahead and arrange for pickup. This is listed on the auction.
A paid receipt and photo ID is required to release the items to the winning bidder.
Third-Party Pickup
The following requirements are needed for a third-party pickup:
1) Email from the auction winner?s Public Surplus account authorizing release of items to the third party.
2) Copy of the paid receipt
3) Personal Identification of third party at time of pickup.
If the auction winner fails to pay for and/or remove the item within the specified time, the City reserves the right to retain all payments and relist the item or dispose of it however the City deems fit.
Bid Deposits
The City may require a bid deposit to participate in certain auctions. The deposit will be reversed if no default occurs or the bidder does not win the auction. The deposit may be retained if the winning bidder defaults.
Taxes & Premiums
A City of Scottsdale sales tax of 8.0% will be added to the winning bid.
A Public Surplus buyer?s premium of 10% will be added to the winning bid ($1 minimum).
Tax Exemption
A completely and accurately filled AZ5000a form is required for anyone claiming tax exemption. Form is required prior to auction payment. In addition, a winning bidder claiming tax exemption must provide documentation that supports a tax exemption claim, e.g., TPT certificate, 501c3, etc?
Tax exemption documentation is not retained. It must be provided for every transaction in which a winning bidder is claiming a tax exemption.
The City reserves the right to deny a tax exemption claim that is not fully supported by the provided documentation.
Vehicle Titles
City of Scottsdale will issue a title or certificate after receipt of payment and during the vehicle pickup. Titles may be subject to any restrictions as indicated in the item description on the website.
Default
A winning bidder may be deemed in default for one or more of the following:
1) failure to observe these terms and conditions
2) failure to make good and timely payment
3) failure to remove all items within the specified time.
Default may result in termination of the bid contract and/or the public surplus user being blocked from participation in future City of Scottsdale auctions.
Blocked
A public surplus user that is blocked by the City can not participate in the City?s auctions. The City is not responsible for the actions taken against the public surplus user by other agencies as a result of the City blocking that user.
The City reserves the right to block any public surplus user that behaves in an inappropriate manner in person or on publicsurplus.com, uses inappropriate language verbally or written, or for any reason the City deems inconducive with a safe, courteous, and professional online auction experience.

Acceptance of Terms and Conditions
By submitting a bid, the bidder agrees that they have read, fully understood, and accepted these Terms and Conditions, and agrees to abide by them, in their entirety.
