Terms & Conditions
General
Buyers must be registered with Public Surplus
to participate in online auctions, and must at least
18 years of age to enter into a contract with The Montana Surplus Property
& Recycling Program.
All property is offered "As-Is,
Where-Is" with no warranty or guarantee, expressed or implied, as to the
properties condition for use. The State of Montana is not responsible for any
omissions or errors in the descriptions and conditions.
All sales are final with no refunds or
exchanges. The State of Montana reserves the right to
reject any/or all bids and can withdraw an item at any time. All bids are
considered a binding contract to purchase the item if the buyer/bidder is
successful in winning the auction. The buyer agrees to indemnify and hold
harmless the State of Montana, the Surplus Property & Recycling Program,
and its employees for any damages, claims, or liability for injuries to persons
or property caused by the removal of equipment or items purchased.
Inspections
Items are available for inspection prior to
the bidding. Item conditions and descriptions can be subjective�we recommend
that the bidders inspect the property prior to bidding. Inspection dates and
times are indicated in the item description. For items �sold on site,� please
refer to the listed contact to schedule an inspection.
Payment Terms
Upon receipt of notice of winning an auction,
payment in full is due by specified date on invoice. The invoice will have
payment instructions. The successful bidder can pay by credit card, cash (U.S.
currency), cashier's check, certified check or money order made payable to the
State of Montana. If arrangements have not been made to pick up and pay for
your item by the due date listed on the invoice, you will be blocked
and your items will be relisted.�
Items will not be shipped by the State of
Montana and are the responsibility of the bidder. Upon receipt of payment in full, the property will be released to
the successful bidder. Once the property has been released, the successful
bidder will have 10 business days to remove the property from the listed
location.
Vehicles
The State of Montana will issue a temporary
registration permit, bill of sale, and a title to the successful bidder upon
payment in full. Titles may be subject to any restrictions as indicated in the
item description. The State of Montana will not issue replacement titles.
Out-of-state purchasers who wish to drive their purchase away will be charged
an $8.00 fee for the temporary registration permit. Open titles cannot be
issued.
Default
Bidders may be barred from participating in
State of Montana Surplus Property & Recycling Program sales for failure to
observe the Terms and Conditions.
Acceptance of Terms and
Conditions
By submitting a bid, the bidder
agrees that they have read, fully understand, and accept the Terms and
Conditions of Online Sales. If the bid is accepted, the successful bidder
agrees to pay for and remove the property by the dates and times specified.
