All items are sold as-is, where-is. There are no warranties or guarantees expressed or implied as to condition, usability, merchantability or fitness for a particular purpose. The City of Arcadia does not test or inspect the item for markings or working conditions.
 
It is the responsibility of the prospective bidder to verify the condition. The bidders are strongly encouraged to inspect the property prior to bidding, and to place bids based solely on personal inspection. Buyers may view auction items Monday thru Thursday from 8:00 AM – 12:00 PM by appointment only. Please contact Carlos Aguilar at 626-254-2710 or caguilar@arcadiaca.gov to schedule viewing appointments.
 
Pick-up by appointment is required and only in person by the winning bidder. Pick-up appointments must be scheduled at least 24 hours in advance. No service of any kind will be furnished by the City, and the successful bidder shall be responsible for weighing, packaging, crating, loading and hauling items. The City does not ship or permit freight pick-ups on site.
 
By submitting a bid, bidder agrees for and on behalf of bidder, bidder's heirs, successors and assigns that bidder shall indemnify and hold City of Arcadia harmless against any claim, demand or cause of action arising or alleged to have arisen out of the sale or failure to sell any item of surplus property, including claims for personal or bodily injury, death or contract damage.
 
Bidders violating these terms will not be issued a refund and will be blocked from future auctions.

City of Arcadia may require a bid deposit.

Pay Mac, Inc. handles all payments for City of Arcadia.

Acceptable forms of payment are: Wire Transfer or Credit Card.
NO CASH, CHECKS, OR MONEY ORDERS WILL BE ACCEPTED!

Payment for an awarded item must be received within five (5) business days after notice of award.

City of Arcadia may charge sales tax. The tax rate will be calculated at the time of bidding. When sales tax is included, the buyer shall add and include the sales tax amount when making payment.

A Buyers Premium of 10.5% will be added to the final sale price with a $1 minimum charge per auction for payment collections. This premium will be visible during the bidding process and added to the total bid.

All sales are final. Public Surplus will notify buyer of receipt of payment via email.

The successful bidder will be responsible for pick-up of item(s) from the agency's premises. Pick-up must occur within ten (10) business days after notification of award. The notice of award, payment receipt, and personal identification must be presented at time of pick-up, or the item will not be released.

The successful bidder will be responsible for packing, and/or loading any item(s) at pick-up, if necessary.
